1. Acceptance of Terms

By accessing or using the NextGen Predict website (nextgenpredict.com) and related services (the “Platform”), you agree to be bound by these Terms of Service (“Terms”).

If you do not agree with any part of these Terms, you must not use the Platform.

1. Eligibility

You must be at least 18 years old to use NextGen Predict.

By creating an account, you confirm that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You are not prohibited from using the Platform under the laws of your jurisdiction

1. Account Registration

To use certain features of the Platform, you must create an account.

You agree to:

• Provide accurate, current, and complete information
• Keep your login credentials confidential
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

1. Description of the Service

NextGen Predict is a prediction market platform that allows users to trade on the outcome of sporting events and other events by buying and selling “YES” or “NO” positions.

Prices move based on market activity. Positions are settled when the market resolves.

We do not offer traditional sports betting. The Platform operates as a prediction market.

1. Deposits, Withdrawals and Funds

• You may deposit supported assets (including USDG) into your account.
• You are solely responsible for ensuring that the wallet address and network you use are correct.
• Withdrawals are processed according to the Platform’s rules and may be subject to verification.
• We are not responsible for losses caused by incorrect wallet addresses, network errors, or third-party issues.
• We reserve the right to delay, suspend, or refuse deposits or withdrawals if we detect suspicious activity or require additional verification.

1. User Conduct

You agree not to:

• Use the Platform for any illegal purpose
• Attempt to manipulate markets or engage in fraudulent activity
• Create multiple accounts to abuse promotions or bonuses
• Use bots, scripts, or automated systems without our permission
• Interfere with the security or proper functioning of the Platform
• Upload or transmit any harmful code or content
• Violate any applicable laws or regulations

Violation of these rules may result in immediate suspension or permanent ban of your account and forfeiture of funds where permitted by law.

1. Risk Disclosure

Trading on prediction markets involves significant risk.

You acknowledge that:

• You may lose some or all of the funds you deposit
• Market prices can be volatile
• Past performance is not indicative of future results
• You are solely responsible for your trading decisions

NextGen Predict does not provide financial, investment, or trading advice. You should only use funds you can afford to lose.

1. Intellectual Property

All content on the Platform, including logos, text, design, software, and trademarks, is owned by NextGen Predict or its licensors.

You may not copy, modify, distribute, or create derivative works without our prior written permission.

1. Disclaimers

The Platform is provided on an “as is” and “as available” basis.

We do not guarantee that:

• The Platform will be uninterrupted or error-free
• Markets will always resolve correctly or on time
• Any specific outcome or profit will be achieved

To the maximum extent permitted by law, we disclaim all warranties, express or implied.

1. Limitation of Liability

To the fullest extent permitted by law, NextGen Predict and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of your use of the Platform.

Our total liability to you for any claim related to the Platform shall not exceed the amount of fees you paid to us in the 3 months preceding the claim (if any).

1. Indemnification

You agree to indemnify and hold harmless NextGen Predict, its operators, and affiliates from any claims, losses, damages, or expenses (including legal fees) arising out of your use of the Platform or violation of these Terms.

1. Termination

We may suspend or terminate your access to the Platform at any time, with or without notice, if you violate these Terms or for any other reason we deem necessary.

Upon termination, your right to use the Platform will immediately cease. Remaining balances may be handled according to our policies and applicable law.

1. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws.

Any disputes arising out of or relating to these Terms shall be resolved through good faith negotiations first. If unresolved, they shall be subject to the exclusive jurisdiction of the competent courts.

1. Changes to These Terms

We may update these Terms from time to time.

When we make material changes, we will update the “Last Updated” date and may notify you via email or through the Platform.

Continued use of the Platform after changes constitutes acceptance of the updated Terms.
